Foxes and hedgehogs on justification through law: a dialogue

The main claim of this book is that a shift can be traced in the way that our increasingly complex, plural societies are conceptualized. Influential thinkers such as Weber, Berlin and Rawls can be characterized as disavowing an objective standpoint from which to balance and harmonize the tensions and conflicts of values in modern societies. Paradoxically, in an interdependent world, an objective standpoint is more crucial than ever. Our societies require legal justifications which are both pluralist and cohesive. The way forward is not only discourse ethics as developed by Habermas, but also the theories of balancing and principles, following Alexy, as a general theory of justification, and as terms of exchange to mitigate the consequences of disagreement. La principal afirmación de este libro es que se puede rastrear un cambio en la forma en que se conceptualizan nuestras sociedades cada vez más complejas y plurales. Pensadores influyentes como Weber, Berlín y Rawls rechazan un punto de vista objetivo desde el cual equilibrar y armonizar las tensiones y conflictos de valores en las sociedades modernas. Paradójicamente, en un mundo interdependiente, un punto de vista objetivo es más crucial que nunca. Nuestras sociedades requieren justificaciones jurídicas que sean a la vez pluralistas y cohesivas. El camino a seguir no es sólo la ética del discurso desarrollada por Habermas, sino también las teorías del equilibrio y los principios, siguiendo a Alexy, como teoría general de la justificación y como términos de intercambio para mitigar las consecuencias del desacuerdo.
